關於反對SCA 5提案致加州眾議員的公開信
尊敬的加州眾議員:
美國華人聯合總會(American Chinese Federation) 及美國加州華裔領導人,與我們的會員社團一起,對參議員Ed Hernandez先生發起的加州憲法修正第五號參議院提案【SCA 5】,在此表示強烈的關注和不滿。
我們認為,2014年1月30日,是當代美國加州政治史上最黑暗的一天。這一天,民主黨占絕大多數的加州參議院批准通過了【SCA 5】,該提案廢止【Prop 209】法案的相關規定,將允許加州根據種族、性別、膚色、文化和出生國別為由,拒絕某個人或者某群人接受公立大學教育的權利。
要理解【SCA 5】提案的內容,我們必須回顧【Prop 209】法案的內容。1996年11月,【Prop 209】法案(也稱加州民權動議)修改了原加州的法律,禁止加州政府機構在政府雇員招聘、公立高等教育和政府工程合同領域依據某個人或某個團體的種族、性別、膚色、文化和出生國別來進行歧視或提供優待。在【Prop 209】法案通過後的18年裡,加州成為美國最多元化的州。並且,我們也由衷支持【Prop 209 】法案通過後為幫助貧困家庭學生而採取的整套完善措施。比如,我們支援諸多加州公立學校在貧困社區進行各方面深度合作,和中學、學生和家長一起物色有前途的青少年,幫助他們進入大學學習,其中包括向他們建議大學錄取所需的正確課程選擇,建議他們參加SAT或者ACT考試,提供他們所需的學習輔導,幫助他們填寫複雜的入學表格,以及建議他們申請合適的大學,等等。我們歡迎這些大學的上述努力,因為這樣做的目的是為了提高貧困學生的自身素質,而不是去試圖修改公立大學招錄新生的標準。
【SCA 5】提案的目的非常明顯,是想移除【Prop. 209】法案關於“公立教育”的規定,企圖把加州大學和其他公立學校排除在州政府機構的定義之外,並且,提倡在公立教育大學錄取中根據種族給予特殊優惠。這將意味著歷史的倒退,也就是,大學錄取將可根據一個學生的種族對其進行歧視。同時我們也注意到,如果該提案獲得通過,那麼,同樣的邏輯是否適用於【Prop 209】法案的另外兩個領域,即:政府雇員招聘、政府工程合同?那麼,又將產生更大的、更多的種族歧視。我們理解, 作為一名參議員,Hernandez先生是想為自己選區的選民和族群發聲,要維護他們的權益,創建所謂的新法,但是這些新法不應在傷害另外一些少數族裔,如華裔,或其他族裔的前提下推出,並且決不能違反憲法的平等保護條款。
美國憲法第14修正案明確規定,要保障美國公民不被各州政府剝奪依法享有的平等保護權利。我們認為,【SCA 5】提案在公立教育大學錄取中根據種族而給予特殊優惠是錯誤的,明顯違反美國憲法第14修正案的平等保護條款。學習用功,成績優異的學生在大學錄取中應該得到公平的對待,而不管他(她)是哪個族裔。作為少數族裔,我們相信憑學業成就而平等對待會更加公平合理,堅決反對歧視。部分族群學生的錄取比例的下降是個事實,但並不表示目前公立大學的新生錄取有對他們進行歧視。
教育是每個國家和社會發展的根本,我們希望加州參、眾兩院的議員們集思廣益,能推出既能鼓勵上進學子,又照顧到貧困學生上學的法案,而不是把某些特定族裔的優秀學生擋在公立大學的門外,讓我們最好的、最優秀的加州公立大學錄取那些原本達不到錄取標準的貧困學生。我們堅信,如果【SCA 5 】提案真的獲得通過,它會大大降低加州公立大學(目前,這些大學是美國最好的公立大學)的教育品質,從長遠來講,也會削弱我們加州作為一個州的整體競爭力。
所以,我們在此呼籲,您對【SCA 5】提案投反對票!

Dear California State Assembly Members,
We, the American Chinese Federation and our members, join many other prominent California leaders and organizations to express very serious concerns about the Senate Constitution Amendment No. 5 (SCA 5) recently introduced by Senator Ed Hernandez.
In our opinion, January 30, 2014 marked one of the darkest days in California’s recent history of politics. On this day, the California Senate, controlled by the Democratic supermajority, approved SCA 5, which would repeal provisions of Prop 209 and allow the State of California to deny an individual or group's rights to public education on the basis of race, sex, color, ethnicity, or national origin.
To understand SCA 5, we have to remember what Prop. 209 is. In November 1996, Proposition 209 (also known as the California Civil Rights Initiative) amended the state constitution to prohibit state government institutions from discriminating against, or granting preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in the operation of public employment, public education, or public contracting. In the 18 years that Prop 209 has been in effect, California has become the most diversified state in the US. Also, we fully support comprehensive measures having since been introduced to help students from disadvantaged families obtain higher education. For example, we support that many California’s public universities have embedded themselves deeply in disadvantaged communities, working with schools, students and parents to identify promising teenagers and get more of them into college by advising them to take the right classes to be eligible for college admission, to take the SAT or ACT, to get academic help when they need it, to fill out complex forms properly or to apply to competitive colleges, etc. We applaud these initiatives taken by these universities, because these efforts aim to change the disadvantage students themselves, i.e., improve their qualifications, but not to change the way they select and enroll new students.
Now SCA 5 seeks to REMOVE any mentioning of “public education” in Prop. 209. The bill even wants to REMOVE University of California and public schools from the definition of State Government Institutions. This will unfairly roll back the clock to discriminate a student simply based on her/his race. If it succeeds, what will be next in its supporters’ minds to be removed between other two areas (public employment and public contracting) in Prop. 209. We understand that as a Senator, Mr. Hernandez shall listen to the voice of his constituency and propose new law to promote the interests of his own constituency, however, the new law he introduced shall at least do not hurt the legitimate interest of another ethnic group and shall not violate the Equal Protection Clause of the Constitution.
The 14th Amendment of the US Constitution clearly states that no state shall deny to any person within its jurisdiction the equal protection of its laws. The SCA 5 is racist and in violation of the US Constitution. We believe preferential treatment based on race in college admission in public education is not the right practice and violates the Equal Protection Clause of the Fourteenth Amendment. Children who study and work hard deserve equal opportunity in college admission regardless of their race. As a minority ethnic group, we believe in merit and in treating everyone equally and we hate discrimination, but the fact that the admission numbers are down for some groups does not mean that there is discrimination in college enrollment in our public universities.
Education is the foundation of each nation and each society’s development. We sincerely hope that every member of California Senate and Assembly work together to introduce new laws which encourage and reward students for their hard work and merit achievement, and at the same time provide or allocate more resources to help disadvantage students, but not laws to replace good students from a specific race with disadvantage students who do not meet the merit requirements of our excellent California public universities. We strongly believe that SCA 5, if passed, will undermine the quality of California’s public education universities, which are among the best in the nation, and will compromise the competitiveness of California as a state in the future.
Thus, we hereby urge you to vote NO to SCA 5! Please also kindly respond at your earliest convenience. Thank you.
